Before we discuss how to file for registration, let’s first understand why it is essential. A trademark differentiates your product from a competitor’s. 

A trademark is a unique sign, symbol, logo, or combination of these. When a company registers for a trademark, it establishes ownership of a brand; thus, no other entity can use similar marks to confuse people about what product belongs to it. 

2. Conduct an Advanced Search

After applying, the Ministry of Economy checks for compatibility with legal requirements. They also check whether the mark conflicts with already registered trademarks or is too generic. 

In these cases, third parties would file the application. This usually arises because they feel the trademark infringes on their rights. When opposition arises, you will be required to prove and argue your case. 

7. Trademark Checks and Approval Award

After all objections and oppositions are resolved and the Ministry of Economy becomes satisfied with the application, the trademark will be published in the Official Gazette. 

Following that period, if no further objections are received, the trademark will be deemed officially registered, and you will receive a brand registration certificate. 

8. Monitor and Enforce Your Trademark

After registration, the company should proactively monitor the market for the company to ensure that no other entity uses your trademark without permission. 

Any discovery by the company of unauthorized use of the trademark should immediately lead to legal action to protect its rights.
